The Home Owner at their option can perform verification on all prospective buyers (“Buyers”) who contact and schedule showings through our platform. Potential buyers will be asked to provide the third-party Company with their identity specific information prior to being able to schedule home viewing. Once verified, buyers name and telephone number is disclosed to you. You will either approve the showing or reject the showing, this decision is at your sole discretion. Upon the seller’s approval of the requested home showing. The data of prospective Buyers otherwise provided to verify their identity is not disclosed to Seller. There is an additional cost of $5.00 per verification
The Company engages a 3rd party provider to provide a home evaluation report for properties. The report provides an estimated of market value. It is not a formal appraisal. The evaluation report is an estimate based upon the 3rd party provider’s market knowledge, and it should be used as a benchmark to determine a home’s value. By accepting the terms and conditions you agree to hold Company harmless for presumed or actual discrepancies in the Home Value Report obtained via our platform and the actual market value of your home.
The home value report provided to you by the Company is licensed solely to the Company by the 3rd Party Provider. It shall not be used or distributed for any purpose without written permission.
Professional real estate photography and video obtained via our platform and services are engaged by 3rd party providers at your sole discretion. Our service provides photo enhancement from your photographs and to be used for marketing material, to sell your home.
The service and its original content, features and functionality are and will remain the exclusive property of Company. The service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks may not be used in connection with any product or service without the prior written consent of Company.
In consideration of being provided scheduling Service at the Property, which Service will be provided by Company in connection with home showings scheduled in accordance with the Terms of Use as previously acknowledged and agreed to, I, the undersigned, acknowledge and agree as follows. The homeowner makes the decision to approve or not approve any potential buyer. The company assumes no responsibility for any scheduled showings or potential buyers.
Assumption of risk, the company’s duties are limited solely to verifying and scheduling access to the Property. You accept full responsibility for accepting the potential buyer and scheduled Home Viewers. The Company will never accompany Scheduled Viewers to the property, you accept the full responsibility of allowing potential buyers entrance into your home. You further understand that the risk of loss of or damage or injury to persons or property on the Property associated with the Showings may be significant, including but not limited to permanent damage to or theft of valuable items located on the Property and serious injury or death of persons coming onto the Property during Showings. I KNOWINGLY AND FREELY ASSUME FULL RESPONSIBILITY AND ALL RISKS, BOTH KNOWN AND UNKNOWN, OF THE SCHEDULING SERVICE AT THE PROPERTY AND USE OF THE SCHEDULING SERVICE, EVEN IF ARISING FROM THE NEGLIGENCE OF THE COMPANY or others.
I understand that I am fully responsible for the condition of the Property, Company shall exercise no control over the Property or its condition, and Company shall owe no duty to any person, including but not limited to Scheduled Viewers and the homeowner, to discover, disclose, warn, remedy, or mitigate any defects or dangers on the Property, latent or patent. I agree to comply with all terms and conditions set forth in the Terms of Use relating to the Showings, Scheduling Service, or any other Service provided by the company.
I hereby RELEASE AND AGREE TO HOLD HARMLESS Company and the officers, directors, officials, agents, employees, volunteers, and representatives of the foregoing (together, “Releasees”), with respect to (a) ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law and (b) all claims, actions and liabilities, whether known or unknown, that I or my heirs may have by reason of all READYSETSOLD Parties’ exercise of the rights granted herein.

An arbitration action, or other action to enforce the terms of this Agreement shall be brought exclusively in the state of Florida. All parties hereby submit to the authority of that court and waives any objections it may have to that court asserting authority over the party, its assets and property.
If any provision is found by a court of competent jurisdiction, to be unenforceable, such provision will be modified, rewritten, or interpreted to include as much of its nature and scope as will render it enforceable. If it cannot be so modified, rewritten or interpreted to be enforceable in any respect, it will not be given effect, and the remainder of these Terms and Conditions will be enforced as if such provision were not included.
This Agreement (i) is the complete agreement between the parties regarding the subject matter hereof; (ii) may be modified only by a written instrument signed by both parties; and (iii) will not be deemed to have been waived by any act or failure to act I HAVE READ THIS LICENSE AGREEMENT, CONSENT, WAIVER, AND RELEASE.
